COLOMBO : The Supreme Court has granted approval to consider the Fundamental Rights (FR) petition filed by former Governor of the Western Province Azath Salley.
The FR petition will be taken up for consideration on December 15 before Chief Justice Jayantha Jayasuriya and Justices S. Thurairajah and Yasantha Kodagoda.
Azath Salley was remanded again on charges of having ties with the suspects implicated in the incident where several Buddhist statues were destroyed in Mawanella. Azath Salley was arrested under the provisions of the Prevention of Terrorism Act (PTA).
After a lengthy consideration of the petitioner and the respondent parties regarding the petition, Chief Justice Jayantha Jayasuriya, S. A three-judge bench comprising Justices Thurairajah and Yasantha Kodagoda decided to hear the petition.
Salley had filed a fundamental rights petition seeking an order to release him from custody, claiming that his fundamental rights had been violated by his arrest and detention without any reason.
The petitioner named the Attorney General, the Inspector General of Police, CID Director Nishantha de Zoysa, Chief Inspector Jayantha Payagala, Minister of Public Security Sarath Weerasekera and Secretary to the Ministry Major General (Retd.) Jagath Alwis.
On Tuesday, October 12, Salley was again remanded by the Magistrate court under the PTA till October 26.
